his Privacy Policy describes the privacy practices of Achronix Semiconductor Corporation, a Delaware corporation, and our subsidiaries and affiliates (collectively, “Achronix”, “we”, “us”, or “our”).

This Privacy Policy applies to information we collect when you:

  • Customer Records: Electronic or physical records containing personal information (e.g., billing details, shipping information, purchase history).
  • Commercial Information: Products or services purchased, obtained, or considered, and other purchasing or consuming histories.
  • Internet/Network Activity: Browsing history, search history, operating system, web browser, information regarding interaction with our websites, applications, or advertisements.
  • Geolocation Data: Physical location or movements (e.g., if you visit our corporate facilities or use certain location-enabled devices).
  • Professional or Employment-Related Information: Contact details, employer, job title, or professional history if you interact with us.
  • Sensory/Audio Information: Recordings of calls to our customer service or sales teams.
  • Uploaded Content: Uploaded files such as text, images, audio, and video, along with metadata associated with uploaded files.
  • Social Media Interactions: We post and interact on social media platforms, such as Facebook, LinkedIn, Twitter, Google, YouTube, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy.
  • Job Applicants: For job applicants, employees and contractors, we may also collect your resume, cover letter, references, employment history, educational background, degrees, licenses, certifications, and personal information you voluntarily disclose while interacting with us. If we hire you, we will also collect your Form I-9 employment verification information and bank account information to pay you by direct deposit. We currently coordinate background checks through SimpliVerified and payroll and benefits through Automatic Data Processing, Inc.

Sources of Personal Information

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly From You: We may collect information you provide directly, such as when you fill out a form, send us an email, or communicate with us in other ways.
  • Automatically: We may collect certain technical information automatically when you navigate our websites or use our products, developer tools and software, such as IP addresses, browser type, pages visited, and general usage information, including through cookies, pixels, web beacons, and similar technologies.
  • Third-Party Sources: We may collect information from third-parties, for example, distributors, sales representatives, logistics and shipping partners, analytics providers, referrals, and business contact databases.

We do not sell your personal information. However, we may "share" personal information or disclose it to third parties for business purposes as outlined below.

In the preceding 12 months, we have disclosed or shared the following categories of personal information:

  • To Service Providers and Contractors: We disclose Identifiers, Customer Records, Commercial Information, and Internet/Network Activity to vendors who assist us with IT, cloud hosting, order fulfillment, shipping, payment processing, data analytics, and marketing.
  • To Advertising/Marketing Partners: We share Internet/Network Activity with third-party advertising networks and analytics platforms to better understand our website traffic.
  • To Affiliates and Corporate Partners: We may share any of the listed categories with our subsidiaries and distribution partners to respond to requests, fulfill orders, and provide technical support.

We Do Not Use Your Input or Output to Train Our Models

When you use our AI Services to access AI models running on our FPGA hardware (“AI Services”), you may provide input in the form of text, images, code, software, audio, video, or other content (“Input”) to generate content based on your Input (“Output”). When you use our AI Services, we do not use your Input or Output, or any data contained in your Input or Output, to train our models.

Retention

We retain information for so long as we have a legal or business purpose.

Children

We do not intend to collect personal information from consumers under the age of 16 years old, and we do not have actual knowledge of such collection. If we learn that we have collected personal information of a child without the consent of the child’s parent or guardian, we will delete it. We encourage parents with concerns to contact us.

California residents have the following privacy rights:

  • Right to Know/Access: You can request that we disclose the categories and specific pieces of personal information we have collected about you (where retained).
